At BM Digital, we maintain a strict no refund or exchange policy for our services. As our offerings are intangible and provided online, they are non-refundable. If our services do not meet your expectations, your sole option is to discontinue use. Should you decide to end your use of our services before the completion of your billing cycle, please be aware that you will not be entitled to a partial or full refund for the unused portion of that cycle. To reiterate, we do not issue refunds, credits, or prorated billing for any canceled services. To initiate a cancellation, please send an email to [item]. It is necessary to complete the cancellation email prior to the discontinuation of your services. Delays in submitting your request may result in your obligation to pay for the next billing cycle. It is important to complete a cancellation email prior to the termination of your services. Failure to submit the cancellation in a timely manner may leave you responsible for the next billing cycle. BM Digital retains the discretion to suspend or terminate this Agreement at any time and for any reason, or even for no reason at all. This Agreement will be terminated immediately, without any prior notice from BM Digital, if you fail to comply with any provision outlined in this Agreement. The termination of this Agreement does not limit any rights or remedies that BM Digital may have at law or in equity in the event of a breach by you of any obligations under this Agreement.

Without limiting the above statement, neither BM Digital nor any of its providers make any representations or warranties of any nature.    

**Limitation of Liability**  

Regardless of any damages you may incur, the entire liability of BM Digital and its suppliers under any terms of this Agreement, along with your exclusive remedy for all matters related to this Agreement, shall be limited to the amount you actually paid for the use of the website. Please note that some states or jurisdictions may not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not be applicable to you.

 **Amendments to this Agreement**   

BM Digital retains the right, at its sole discretion, to amend this Agreement at any time. In the event of a significant revision, we will provide a minimum of 30 days' notice prior to the implementation of any new terms. The determination of what constitutes a material change will be made solely by us.

This Agreement represents the complete understanding between you and BM Digital concerning your use of the website and supersedes all prior written or oral agreements between you and BM Digital. Additional terms and conditions may apply when you utilize or purchase other services from BM Digital, which will be communicated to you at the time of such use or acquisition. 

 **Intellectual Property**  

 All services, along with their contents, features, and functionalities (including but not limited to all text, images, video, audio, software, and their respective designs and arrangements), are owned by BM Digital or its licensors and are safeguarded by United States and international laws concerning copyright, trademark, patent, trade secret, and other intellectual property rights. 

 **Notice of Dispute**   

Should a dispute arise, either you or BM Digital must provide the other party with a Notice of Dispute. This notice should be a written statement that includes the name, address, and contact details of the party issuing it, the facts that have led to the dispute, and the specific relief sought. You must send any Notice of Dispute via email to: brian@bmdigitalmarketing.net. BM Digital will send any Notice of Dispute to you via mail to your listed address if available, or otherwise to your provided email address. Both parties will endeavor to resolve any disputes through informal negotiation within thirty (30) days of sending the Notice of Dispute. If resolution is not achieved within this timeframe, either party may initiate arbitration. 

 **Submissions and Privacy**  

If you submit or post any ideas, creative suggestions, designs, photographs, information, advertisements, data, or proposals, including ideas for new or improved products, services, features, technologies, or promotions, you agree that such submissions will be regarded as non-confidential and non-proprietary.

Please be aware that each Promotion may be subject to specific rules that outline eligibility requirements.
